Aldon Smith Receives Probation for DUI Charge

Posted by William Kirk, Partner | Jul 19, 2014 | 0 Comments

Any bad news for the San Francisco 49ers is good news for the Seattle Seahawks. Last week, 49ers linebacker Aldon Smith was sentenced to three years probation and 11 days community service following a no contest plea to a drunk driving and weapons charge, reports NESN.

Smith had faced three felony charges; however, the Superior Court judge considered the fact that Smith did not have a criminal record involving violence in ordering probation. Smith was warned that if he violated any of the terms of his probation, he would be sent to jail for 11 days. Court officials maintain that Smith did not receive any special treatment in only receiving probation.

The DUI charges against Smith stem from an incident last fall where Smith crashed his car into a tree in San Jose. Smith measured a blood alcohol level over twice the legal limit. While Smith avoided significant criminal penalties for the time being, he could still face administrative penalties from the team or from the NFL -- including a possible suspension. In a relatively short period of time, Smith has racked up an assortment of off the field issues that Commissioner Roger Goodell does not look kindly upon.
