What Are Coast Guard Hearings?
On international waters or along the national coastline, the US Coast Guard may deal with any intoxicated boaters they arrest. The boater faces immediate penalties from the Coast Guard, although they may appeal through a Coast Guard hearing. If successful, the charges may be dropped altogether.
An accused boater needs to follow these rules to schedule and attend a Coast Guard hearing:
- All hearings need to be requested through writing
- Hearing requests should outline what will be addressed in the hearing
- Any evidence submitted to the hearing should be provided by the defendant
- The defendant is responsible for hiring their own legal counsel
- The Coast Guard allows video or in-person hearings
These hearings may not be the same as a traditional trial, but the arguments and legal know-how to defend from BUI charges can often prove highly technical. A defendant may still want to rely on the experience and knowledge of a lawyer.
